    This Privacy Policy describes how Litmus Automation Inc. and its affiliates ("Litmus", "us", "we", or "our") process personal information collected through https://litmus.io/ (the "Site), email newsletter subscriptions, as well as registration for or access to Litmus’s software and resources (including Litmus Edge and Litmus Edge Manager) (all of the foregoing are collectively, "Litmus Offerings"). This Privacy Policy applies solely to information collected in connection with the Litmus Offerings, including information provided when applying for a job with Litmus via the Site. It will inform you of items including but not limited to the following:
    • What Personal Information is collected from you through the Litmus Offerings, how it is used and with whom it may be shared;
    • What choices are available to you regarding the use of your Personal Information; and
    • The update procedures that are in place to protect the use of your Personal Information.
    Please read this Privacy Policy carefully before using the Litmus Offerings. By using the Litmus Offerings or otherwise providing Personal Information to us, you agree to Litmus' data collection, use, and disclosure practices, other activities as described in this Privacy Policy.
     
    Changes to this Privacy Policy
     
    We may change our Privacy Policy from time to time and will post the date it was last updated at the top of this Privacy Policy. When required under applicable law, we will provide additional notice to you if we make any changes that materially affect your privacy rights.
    Personal Information We Collect
    "Personal Information" is any information that, alone or in combination with other information, is linked or can be linked to an identifiable individual. Unless otherwise required under applicable laws, Personal Information does not include business contact information or anonymized information that is maintained in a form that is not capable of being associated with or linked to an individual.

    We may collect the following types of Personal Information through the Litmus Offerings:
    • Identification and Contact Information, including your name, title, alias, postal address, phone number, email address, government identification numbers, and social media usernames;
    • Electronic network activity and usage information ("Usage Information"), including IP address, device identifier, network connected hardware data, browser type and language, operating system, internet or mobile network provider, information about your use of the Litmus Offerings, Litmus Offerings access time and duration of visit; and
    • Registration and Profile Information, including username and password for our Site or to otherwise access the Litmus Offerings, and security question/answer combinations; and
    • In the case of job applicants, education history and work experience.
     
    How We Collect Your Personal Information
     
    We collect your Personal Information through various means, including when you directly provide it to us and automatically through your use of the Litmus Offerings. For clarity, Litmus Edge and Litmus Edge Manager are not intended to collect or otherwise process Personal Information, unless you choose to provide it to us. We may also collect Personal Information about you from our Service Providers (as defined below) through the use of cookies. In some instances, you may be able to choose what information to provide, but sometimes we require certain information from you to use features of the Litmus Offerings.
    Information that You Provide
    We collect Personal Information directly from you when you:
    • Register or maintain an account with us;
    • Register to attend our events;
    • Contact us through email or other direct contact;
    • Contact us using our online form;
    • Exchange communications with us by mail, email, phone, etc.; or
    • Apply for a job with us.
     
    Information Collected Automatically
     
    We, and our service providers, use cookies, log files, web beacons, pixels, and other tracking technologies (collectively, "Cookies") to collect and store Usage Information about you and your interactions with the Litmus Offerings.
    We may combine automatically collected information with other Personal Information we obtain about you, which may include data we obtain from third parties. Cookies may be used to collect Personal Information about your online activities over time and across different online services.

    Information We Collect from Other Sources
    Litmus may also obtain information about you from other sources, including our service providers and our affiliates. In some circumstances, we may also obtain Personal Information about you from third parties, including business partners, resellers, and data brokers, some of which may sell the information to us. To understand your rights and choices regarding Personal Information collected by other companies, please consult the privacy policies of the businesses that you interact with.
     
    How We Use Personal Information
     
    We may use the Personal Information we collect about you through the Litmus Offerings for various purposes, including to:
    • Respond to your emails or other requests, inquiries, comments, or questions;
    • Consider your application if you have applied to work with us;
    • Facilitate access to the Litmus Offerings or Litmus events;
    • Personalize and improve your online experience with us, such as by providing you with content that may interest you and making navigation on our Site easier;
    • Monitor and analyze trends, usage, and activities of visitors to, and users of, the Litmus Offerings;
    • Improve the Litmus Offerings, our marketing, and products or services we may offer;
    • Send you marketing materials and advertisements;
    • Contact you regarding your use of the Litmus Offerings;
    • Verify and/or authenticate your identity in connection with your use of the Litmus Offerings;
    • Provide you with information that we believe may be useful to you, such as information about products or services offered by us or by others;
    • Prevent fraud or other misuse of the Litmus Offerings, including protecting our rights and the rights of affiliates or related third parties;
    • Maintain records of our transactions and communications;
    • Conduct research and analytics;
    • Comply with applicable laws, regulations, or legal process as well as industry standards and our company policies;
    • For any other purpose, with your consent or as otherwise permitted under applicable law.
    How We Disclose Personal Information
    We may disclose your Personal Information as follows:
    • Within our group of companies including with our affiliates, subsidiaries, locations, and brands.
    • With third parties as necessary to fulfill your request or for the purpose for which the Personal Information was provided to us, e.g. subscribe to our newsletter, coordinating attendance at Litmus events or to receive product information in digital format; and
    • With third parties in connection with or during negotiations of any reorganization, acquisition, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceeding).
    Interactive Features
    Your use of the interactive features on the Litmus Offerings is voluntary, and we may retain the information that you submit through these features. For example, we may offer an interactive chat feature on the Litmus Offerings to answer questions and for other customer service purposes. When you participate in the interactive chat, either with a virtual or live agent, the contents of the chat may be captured and kept as a transcript.
     
    Cookies and Analytics
     
    As described above, we use Cookies for purposes, such as recognizing your device when you visit the Site, monitoring your activity as you navigate the Site, or analyzing your use of the Site. This information may be used to track your activity over time on various websites and services, as well as across different devices you may use to access the Internet and our Site. In general, our Site use Cookies as follows:
    • Where necessary to run our Site, for example by allowing you to log in;
    • To optimize the functionality of our Site, including by personalizing content for you and remembering your preferences (e.g., your choice of language or region);
    • For analytics purposes, including to help us understand how our Site is used, to see what products or services most interest you, and determine how best to market our products and services to you;
    • For purposes of ad targeting and marketing, including to collect information about your browsing behavior on our Site in order to show you interest-based advertising when you visit other websites or use social media;
    • To determine if you open or act upon our email messages (information on unsubscribing from our commercial email communications is provided below); and
    • To obtain information about your interactions with our online advertisements, such as whether you clicked on an ad and the website where you may have seen the ad.
    Cookies may generally be disabled or removed by tools available as part of most commercial browsers, and in some instances blocked in the future by selecting certain settings. Please note that if you disable cookies, some features of our Site may not function properly and disabling Cookies may invalidate your other opt outs that rely on Cookies to function.

    Our Site also uses analytics technology provided by our service providers to understand how users interact with the Site, improve our web experience, and better market our products and services. Analytics services in use by Litmus include Google Analytics, ZoomInfo and HubSpot.

    We use information from Google Analytics to implement Google advertising features such as interest-based advertising, audience targeting, and display advertising. You may exercise choices regarding the use of cookies from Google Analytics by going to Google’s opt-out page or downloading the Google Analytics Opt-Out Browser Add-on. For more information on how Google Analytics uses data it collects, visit Google’s privacy page. We may also use advertising services provided by Google Ad Services.     Litmus is not responsible for the effectiveness of any third parties’ opt-out options or the accuracy of their statements regarding their programs.
     

    Advertising and Marketing
     
    We may use third-party advertising partners that may use their own Cookies and our Cookie data to show you personalized ads and to measure the effectiveness of these ads. We may provide these third-party advertisers with information about your use of the Litmus Offerings as well as aggregate or non-personal information about users of the Litmus Offerings. They may use this information to build or enhance their understanding of you and your interests to provide you with more relevant ads.

    Links to Non-Litmus Websites
     
    The Litmus Offerings may include links to non-Litmus websites for your convenience and information. These third-party websites may have their own privacy policies or notices, which we encourage you to review. By clicking on links to third-party websites, their operators may collect your Personal Information. We are not responsible for the content or data collection practices of these third-party websites, and your use of them is subject to their respective terms of use and privacy policies. This Privacy Policy applies solely to information collected through the Litmus Offerings. Litmus is not responsible for the privacy practices or content of any linked websites that we do not control.
    Your Privacy Rights
    Where permitted by applicable law, you may be able to exercise the following rights:
    • Access your Personal Information. You may request access to the Personal Information we hold about you.
    • Correct your Personal Information. You may request that we correct inaccuracies in your Personal Information, taking into account the nature of the Personal Information and our purposes for processing it.
    • Request the Deletion of your Personal Information. You may request that we delete your Personal Information.
    • Withdraw your Consent. Where you have provided your consent to the collection, use, and transfer of your Personal Information, you may withdraw your consent under certain circumstances. Please note that if you withdraw your consent we may not be able to provide you with a particular service. We will explain the impact to you at the time to help you with your decision.

    We may request specific information from you to help us confirm your identity and your right to exercise the above-noted rights. Applicable law may allow or require us to refuse to accommodate your request, or we may have destroyed, erased, or made your Personal Information anonymous in accordance with our record retention obligations and practices. If we cannot accommodate your request, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

    Email Communications
     
    You may unsubscribe from our marketing email communications by clicking the "unsubscribe" link found in every commercial email we send, or by sending a request to unsubscribe at the contact information set out below. If you opt-out of our marketing email communications, we may still send you email messages related to your account or subscriptions. Unsubscribing from our marketing communications will not affect the level or quality of service we provide to you.

    Security
     
    We take commercially reasonable measures to protect Personal Information from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. Nevertheless, transmission via the Internet and electronic storage are not completely secure, and Litmus cannot guarantee the security of your Personal Information. You are responsible for maintaining the secrecy of any credentials used to access your account with us.

    Data Retention
     

    Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize your Personal Information so that it can no longer be associated with you.

    Age Restrictions
     
    The Litmus Offerings are not intended for children under the age of eighteen (18) and we do not knowingly collect Personal Information from children through the Litmus Offerings.
    Cross-Border Transfer of Personal Information
    The Personal Information collected through the Litmus Offerings may be transferred to, processed, stored, and used in countries or provinces other than the country or province you are resident, and be accessible to the law enforcement and national security authorities of those jurisdictions. These countries or provinces may have data protection laws that are different from those of your country or province of residence. Your use of the Litmus Offerings or provision of any Personal Information to us constitutes your consent to the transfer to and from, processing, usage, sharing, and storage of your information in those jurisdictions, as set forth in this Privacy Policy.
