IN THE EVENT OF A CONFLICT BETWEEN ANY AGREEMENT AND THESE TERMS, THE AGREEMENT(S) SHALL GOVERN AND CONTROL.
THESE TERMS INCLUDE AN AGREEMENT TO RESOLVE DISPUTES BY ARBITRATION, WHICH MEANS THAT YOU AND LITMUS WAIVE THE RIGHT TO A TRIAL BY JURY AND AGREE TO RESOLVE ANY AND ALL DISPUTES THROUGH BINDING ARBITRATION, ON AN INDIVIDUAL BASIS.
You represent and warrant to Litmus that you are at least eighteen (18) years of age and that you possess the legal right and ability to enter into these Terms, including without limitation that you have the authority to contractually bind the organization that you represent.
Although the Site may be accessed globally, if any material on the Site, or your use of the Site, is contrary to the laws of the country where you are when you access it, the Site is not intended for you, and you should not access or use the Site. You are responsible for informing yourself of the laws of your jurisdiction and complying with them.
If you are an entity, organization, or company, or acting on behalf of one, you represent and warrant that you are an authorized representative of such entity, and that you have the authority to and agree to bind it to these Terms. The Litmus trade name, logos, slogans and other word or design marks which appear on the Site are trademarks of Litmus (collectively the “Trademarks”).
Litmus owns or has license to all rights, title, interest, copyright and other worldwide intellectual property and trade secret rights in and to the Materials, including Trademarks, and all derivatives or improvements thereof. All Materials, including the Trademarks, may not be used without Litmus’ express written permission. Furthermore, such trademarks may not be used in any manner that is likely to cause confusion among consumers or in any manner that disparages or discredits Litmus. All other trademarks not owned by Litmus or its affiliates that appear on this Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Litmus. You acknowledge that Litmus’ AI services are experimental, may provide inaccurate or offensive content, may use submitted information for training, and should not be relied on for professional advice. You assume all responsibility for the use of any AI-generated output.
You must keep any username, password, or other security information confidential and notify us immediately of any unauthorized access. You agree not to attempt to circumvent or violate the Site’s security measures.
Access to the Site may be interrupted at any time for any reason. Litmus shall not be liable for any inability to use the Site due to factors beyond its control.
Litmus does not warrant the accuracy, reliability, completeness, or timeliness of the Site. You assume all risks associated with its use.
